General Terms and Conditions

General Terms and Conditions of Nikos Health Hub OÜ for the 12-week 1:1 coaching “Erectile Health”.

§ 1 Scope and definitions

(1) These General Terms and Conditions apply to all coaching contracts between Nikos Health Hub OÜ (hereinafter the “Provider”) and a consumer, in the version valid at the time of booking.

(2) A consumer is any natural person who concludes a contract for purposes that cannot be attributed predominantly to their commercial or self-employed professional activity (Section 13 of the German Civil Code, BGB).

§ 2 Subject matter of the contract

(1) The subject matter of the contract is the delivery of an individual 1:1 coaching programme over 12 weeks on the topic of erectile health and supporting lifestyle factors.

Important notice: The coaching does not constitute medical advice and does not replace a medical or urological examination, diagnosis or treatment. It can only be used as a supplement to existing medical treatment. If you have existing or newly arising health complaints, you must always see a doctor first.

§ 3 Conclusion of the contract

(1) Via the Provider’s website, the customer can arrange a non-binding, free intro call through the appointment booking service Calendly. The intro call serves mutual assessment and does not in itself constitute the conclusion of a contract.

(2) A coaching contract is only concluded once the Provider, after the intro call, makes the customer an individual offer and the customer expressly accepts this offer (e.g. by e-mail confirmation or payment). The presentation of the coaching on the website does not constitute a binding contractual offer by the Provider.

(3) The Provider stores the contract text and sends the customer the essential contract details by e-mail.

§ 4 Services and delivery

(1) After the contract is concluded, the customer receives access to the 12-week 1:1 coaching programme according to the individually agreed schedule. The individual coaching sessions are arranged between the Provider and the customer depending on availability.

(2) The coaching is delivered online and discreetly.

§ 5 Prices and payment

(1) The prices communicated at the time of the individual offer include statutory value added tax (where applicable) and other price components.

(2) The customer may pay using the payment methods stated in the individual offer.

§ 6 Right of withdrawal

Consumers are in principle entitled to a statutory right of withdrawal of 14 days after the conclusion of the contract. If the coaching is started before the withdrawal period has expired at the express request of the customer, the customer must, in the event of withdrawal, pay compensation for the services already provided up to the time of withdrawal. Detailed withdrawal information will be provided to the customer with the individual offer.

§ 7 Warranty

The statutory warranty provisions apply. A cure or a particular health outcome is not guaranteed; the coaching is a service, not a promise of medical treatment.

§ 8 Contract language

The contract languages available are German and English. The language of the coaching sessions is agreed individually.

The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
